RIGHT OF WITHDRAWAL – DISTANCE SALES
This Article 2 applies to Customers who qualify as consumers within the meaning of the preliminary article of the French Consumer Code.
2.1. CONDITIONS FOR EXERCISING THE RIGHT OF WITHDRAWAL
In accordance with current legislation governing distance selling, the Customer has a period of fourteen clear days to exercise their right of withdrawal without having to justify any reason or pay any penalties, except, where applicable, return costs.
The period mentioned in the previous paragraph runs either from the day the distance contract is concluded for contracts relating to the provision of services and/or digital content not supplied on a tangible medium, or from receipt of the goods by the Customer or a third party, other than the carrier, designated by them, for contracts for the sale of goods and service contracts including delivery of goods.
In the case of an order for several goods delivered separately or an order for goods consisting of multiple batches or parts delivered over a defined period, the period runs from receipt of the last good, batch, or part. For contracts providing for regular delivery of goods over a defined period, the period runs from receipt of the first good.
If the fourteen-day period expires on a Saturday, Sunday, or public holiday, it is extended until the next working day.
The decision to withdraw must be notified to Sober Spirits using the contact details provided in Article 1 of these general terms by means of an unambiguous statement. In all cases, Sober Spirits will send the Customer an acknowledgment of receipt of the withdrawal by email as soon as possible.
2.2. EFFECTS OF THE RIGHT OF WITHDRAWAL
The Customer shall return or hand back the products to Sober Spirits or any person designated by it, without undue delay and no later than fourteen days after communicating their decision to withdraw.
When the right of withdrawal is exercised, Sober Spirits must reimburse the Customer for all sums paid. Where applicable, Sober Spirits may delay reimbursement until safe recovery of the Products. The Products must be delivered in perfect condition, otherwise reimbursement canno't be made.
Where applicable, Sober Spirits shall reimburse using the same means of payment as that used by the Customer for the initial transaction, unless the Customer expressly agrees to a different method and provided that the reimbursement does not incur any fees for the Customer. However, Sober Spirits is not required to reimburse additional costs if the Customer has expressly chosen a more expensive delivery method than the standard option offered.
The direct costs of returning the Product are borne by the Customer.
The Customer’s liability is only engaged in respect of depreciation resulting from handling other than what is necessary to establish the nature, characteristics, and proper functioning of the Product.
2.3. EXCLUSIONS FROM THE RIGHT OF WITHDRAWAL
The right of withdrawal does not apply, in particular, to contracts:
for the supply of services fully performed before the end of the withdrawal period and whose performance began after the Customer’s prior express agreement and express waiver of their withdrawal right;
for the supply of goods made to the Customer’s specifications or clearly personalized;
for the supply of goods liable to deteriorate or expire rapidly;
for the supply of goods that have been unsealed by the Customer after delivery and cannot be returned for hygiene or health protection reasons;
for the supply of goods which, after delivery, are inseparably mixed with other items;
for the supply of digital content not supplied on a tangible medium where performance has begun after the Customer’s prior express consent and express waiver of their withdrawal right.
Likewise, the right of withdrawal does not apply to contracts fully performed by both parties at the Customer’s express request before the Customer exercised their withdrawal right.
When validating an order for services, the Customer’s waiver of the withdrawal right is expressed by checking the box corresponding to the following statement: “I expressly waive my 14-day withdrawal right for services from which I will benefit before the expiry of this period.” The Customer will then receive email confirmation of this waiver.
A Customer who exercises their right of withdrawal from a service contract whose performance began, at their express request, before the end of the withdrawal period shall pay the professional an amount corresponding to the service provided up to the communication of the withdrawal decision, proportional to the total contract price.
TERMINATION OF THE CONTRACT AT THE CUSTOMER’S INITIATIVE
A consumer Customer may terminate the contract by registered letter with acknowledgment of receipt if delivery of the goods exceeds the agreed date by more than seven days. The Customer will then be reimbursed for the amounts paid when placing the order.
This clause does not apply if the delivery delay is due to force majeure. In such a case, the Customer agrees not to take legal action against Sober Spirits and waives the right to rely on termination of the sale under this article.
WARRANTIES
4.1. WARRANTY FOR APPARENT DEFECTS
It is the Customer’s responsibility to check the condition of the Products upon delivery. This verification must cover, in particular, the quality, quantities, and references of the Products as well as their conformity with the order. No claim will be accepted after a period of three days from delivery. In any event, claims relating to delivered parcels will only be accepted if the Customer acting as a merchant has issued reservations to the carrier in accordance with Articles L.133-3 and following of the French Commercial Code.
4.2. WARRANTY FOR HIDDEN DEFECTS
4.2.1. LEGAL WARRANTIES
Customers benefit from a legal warranty of conformity of delivery (Article 1604 of the French Civil Code), a legal warranty against hidden defects (Articles 1641 et seq. of the French Civil Code), and a safety warranty (Articles 1245 et seq. of the French Civil Code).
Customers who qualify as consumers also benefit from a legal warranty of conformity (Articles L.217-4 et seq. of the French Consumer Code).
4.2.3. RETURNS
To implement the warranty, the Customer must return the product to the registered office address of Sober Spirits, accompanied by an explanatory letter requesting repair, replacement, or refund.
In all cases, the Customer must strictly follow Sober Spirits’ instructions regarding Product returns.
Return costs remain the responsibility of the Customer, except for consumer Customers exercising the legal conformity warranty under Articles L.217-4 et seq. of the French Consumer Code.
