Sober Ambassador programme terms
Version 1, effective from 1 November 2026.
Article 1. Organiser
The programme is organised by SOBER SPIRITS SAS, with share capital of €10,000, registered office at 6 rue Dumenge, 69004 Lyon, registered with the Trade and Companies Register (RCS) of Lyon under number 890 239 486, represented by Calixte Payan, President (hereinafter “Sober Spirits”).
Article 2. Purpose
The Sober Ambassador programme rewards customers who introduce Sober Spirits to their friends and family and share their cocktails on video. These terms set out the benefits, each party’s commitments and the rights assigned in the videos.
Article 3. Participation
The programme is open by invitation to customers aged 18 or over who have placed at least 3 orders on soberspirits.com. Registration is made via the online form and constitutes acceptance of these terms. Sober Spirits may refuse a registration without having to give a reason.
Article 4. Benefits
- Personal code: 10% off their own orders for the entire duration of their participation.
- Code to share: a code in their name giving their friends and family 10% off, usable once per person.
- Previews and private sales reserved for ambassadors.
- Co-creation: the option, if they wish, to take part in testing and choosing upcoming products.
- Referral tiers: gifts based on the number of orders placed with their code to share, according to the scale communicated at registration. Only orders that are paid, not refunded and placed by people other than the ambassador count.
Codes cannot be exchanged, refunded or combined with other codes unless otherwise stated in the basket.
Article 5. Video
After registration, Sober Spirits sends the ambassador 2 complimentary bottles of their choice. The ambassador films a video featuring Sober Spirits and sends it to Sober Spirits, preferably within 30 days of receipt. Sober Spirits is free to decide whether or not to publish the video.
The ambassador guarantees that:
- every person seen or heard in the video is aged 18 or over and has given their consent;
- the video contains no music, image or brand belonging to a third party without authorisation;
- the video shows no dangerous or illegal conduct.
Article 6. Assignment of rights in the video
By accepting these terms, the ambassador authorises Sober Spirits, pursuant to Article 9 of the French Civil Code, to use their image, voice and first name as they appear in the videos sent. The ambassador also assigns to Sober Spirits, in accordance with Articles L131-1 et seq. of the French Intellectual Property Code, their copyright in these videos:
- right of reproduction: copying and recording the video on any digital or printed medium;
- right of communication to the public: broadcasting the video on the soberspirits.com website, in emails, on social networks (including Instagram, Facebook, TikTok, YouTube, Pinterest, LinkedIn), in sponsored online advertising, at trade fairs and at points of sale;
- right of adaptation: reframing, shortening, cutting, subtitling, translating, adding music, text or a logo, provided that the video is not distorted and the ambassador’s reputation is not harmed.
This assignment applies worldwide for a period of 5 years from the sending of each video. It is granted in return for the 2 bottles and the benefits of Article 4, without any further remuneration. Sober Spirits may credit the ambassador’s account when broadcasting if it wishes.
Article 7. Right of withdrawal
The ambassador may ask at any time for the use of a video to stop by writing to hello@soberspirits.com. Sober Spirits will then cease any new broadcasting and any sponsored advertising within 30 days. Posts already online on its own accounts may remain there.
Article 8. Ambassador’s posts
If the ambassador posts content on their own accounts showing the products received or their code, they must state this clearly, for example “Paid partnership with @soberspirits”, in accordance with French Law No. 2023-451 of 9 June 2023. Sharing the code on promo code or deals websites is prohibited.
Article 9. Duration, renewal and end of participation
The title of Sober Ambassador is granted for 12 months from registration. It is renewed for 12 months if at least 5 orders have been placed during this period, counting both the ambassador’s own orders and those placed with their code to share. One month before the end date, Sober Spirits informs the ambassador how many orders they still need. If the threshold has not been reached by the end date, the title ends and the codes are deactivated. Gifts already earned remain the ambassador’s.
The ambassador may leave the programme at any time by simple email. Sober Spirits may end their participation in the event of abuse, fraud or breach of these terms, or discontinue the programme by giving ambassadors 30 days’ notice. The codes are then deactivated. Rights assigned in videos already sent remain vested, subject to Article 7.
Article 10. Personal data
Sober Spirits, as data controller, collects the ambassador’s surname, first name, email, address, social media account and videos in order to manage their participation, send their gifts and track their referrals. This processing is based on the performance of these terms. The data is accessible to the Sober Spirits team and its technical service providers (Shopify, Klaviyo, carrier). It is kept for the duration of participation and then for 3 years, and the videos for the duration of the assignment. The ambassador may access, rectify or erase their data or object to its processing by writing to hello@soberspirits.com, and may lodge a complaint with the CNIL (cnil.fr).
Article 11. Changes
Sober Spirits may amend these terms. Each ambassador is notified by email 30 days before a new version comes into force and may leave the programme if they do not accept it. Videos already sent remain governed by the version accepted when they were sent.
Article 12. Governing law
These terms are governed by French law. The parties will first seek an amicable solution. Failing this, the dispute will be brought before the competent courts.
This translation is provided for convenience. In case of discrepancy, the French version prevails.
